The following describes the Menawat and Company, Inc. privacy policy and the manner in which Menawat and Company, Inc. ("Vayoom," the "Company", “we,” “us,” or “our”) collects, uses, shares and secures the personal information that it collects or receives via its website www.Vayoom.com, any sub-domain, other Vayoom website and mobile applications (collectively, the “Sites”), or through your use of the services we provide to you ("Services"). It also describes your choices regarding use, access and correction of your personal information.

As used in this policy, "personal information" means any information that may be used, either alone or in combination with other information, to identify an individual. When we combine any non-personal information with personal information (e.g., technical information, such as the type of browser or operating system that you use), we treat the combined information as personal information.

For the purposes of the EU General Data Protection Regulation 2016 (the “GDPR”) Vayoom is both a data controller and data processor for personal information collected by it via the Sites or Services.

By accessing or using the Services, you agree to this Privacy Policy and consent to the use of your information in the manner set out in this Privacy Policy. If you do not agree to any of the provisions of this Privacy Policy, please do not access or use the Sites or Services and contact us in order to correct, amend, or delete any information we may have collected.

APPLICABILITY OF THIS PRIVACY POLICY

Please note that this Privacy Policy does not apply to any personal information collected by Vayoom other than personal information collected through the Sites or Services. This Privacy Policy shall not apply to (a) information and data that has been irreversibly anonymized, de-identified, or otherwise no longer or never could identify or be used to identify an individual, (b) “Machine Data” (meaning log files, metrics, traces and any other information or data ingested by or uploaded to our Services that does not or never could identify or be used to identify an individual), and (c) third-party websites or online services linked to the Services (“Third Party Linked Sites”). We are not responsible for the privacy or data security practices of any Third Party Linked Sites, and inclusion of a Third Party Linked Site does not imply an endorsement of any kind. We encourage you to review the privacy policies and learn the privacy practices of the entities responsible for Third Party Linked Sites.

COLLECTION AND USE OF PERSONAL INFORMATION

We may collect the following personal information from you that you provide to us, directly or indirectly:

  • Contact information such as name, email address, mailing address, phone number
  • Billing information such as credit card number, and billing address
  • Unique identifiers such as user name, account number, password; note we may collect such information about you regarding your accounts with third-party services when you link those services to your account
  • Preferences information you provide such as product or content interests, or communication or marketing preferences
  • Usage activity about how you interact with us such as what content you viewed, and which areas of our site you visited
  • Information collected automatically about your device and your usage of the Services, such as IP address, browser type, referring/exit pages, and operating system

We may also collect information about you from third parties, such as when others give us your information (e.g., to invite you to use the Services), when we receive data from data enrichment services (e.g., to better tailor our communications to you), or when you link your account to third party services (e.g., when you link your email account to upload your contacts). We will only use information collected from third parties for the specific reason for which it was provided to us and for no other purpose.

We use the information we collect to:

  • Provide you with the Services
  • Process and fulfill your orders and requests
  • Provide you with customer support or technical support, and to respond to your requests and inquiries

  • Send you newsletters or other promotional or marketing communications, and to monitor the performance of our advertisements and marketing efforts
  • Linking your account with accounts you have with third-party service providers
  • Securing the Services and our systems
  • Sharing with third parties for the purposes discussed in “Disclosure to Third Parties”, below

DATA RETENTION

We retain personal information no longer than is necessary for the purposes for which it is processed, unless applicable law requires storage for a longer period of time.

DISCLOSURE TO THIRD PARTIES

We disclose information we collect in the following cases:

  • You asked us to or otherwise gave your specific consent.
  • With vendors, we engage to provide you with aspects of the Services, such as facilitating communications with you and other users, maintaining our databases, and processing payments.
  • As required by law, such as to comply with a subpoena, or similar legal process when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request
  • As necessary if Vayoom Inc. is involved in a merger, acquisition, reorganization, dissolution, sale of all or a portion of its assets or similar event; provided that, in such an event, you will be notified via email and/or a prominent notice on our Web site of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information, to subsidiaries and affiliates for purposes consistent with this Privacy Policy

TRACKING TECHNOLOGIES

We or a third party contracted by us may use technologies such as cookies, Web beacons, or scripts to gather information about how you and others interact with our Web site. For example, we will know how many users access a specific areas or features within our site and which links or ads they clicked on, or we may set a cookie on your browser that allows you to access the Services without needing to remember and then enter a password more than once during a visit to the site. We use this aggregated information to understand and optimize how our site is used, improve our marketing efforts, and provide content and features that are of interest to you.

If you would prefer not to accept cookies or to disable our use of tracking technologies, most browsers and mobile devices allow you to change your settings with respect to such technologies.

Please note that, if you continue to use the Services without blocking or disabling cookies or other tracking technologies, you hereby consent to our use of these tracking technologies and to our use of any personal information that we collect through their use.

CHILDREN UNDER THE AGE OF 16

The Sites and Services are not intended for children under the age of 16. Accordingly, we do not intend to collect personal information from anyone we know to be under 16 years of age.

SECURITY

The security of your personal information is important to us. When you provide sensitive information (such as a credit card number) to us, we encrypt the transmission of that information using secure socket layer technology (SSL). We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee its absolute security. ACCESS AND CONTROL OF YOUR PERSONAL INFORMATION

You can access, correct, amend, or delete certain personal information by accessing the settings of your account. If you cannot find the relevant personal information there, you may contact us at privacy@menawat.com and we will assist you. You may opt-out of certain collection, use, and disclosure practices. Specifically:

  • You may choose to stop receiving our newsletter or marketing emails by following the unsubscribe instructions included in these emails or you can contact us at privacy@menawat.com.
  • You may opt-out of certain cookies and tracking technologies. Please see the instructions in the “Tracking Technologies” section, above.
  • You may opt out of all collection by terminating your account with us and ceasing all use of the Services. To delete your account, please email us at privacy@menawat.com. We will then delete your personal information within a commercially reasonable period of time; provided, however, that we may need to retain some personal information that is otherwise deleted in archived or backup copies as required pursuant to records retentions obligations, to resolve disputes or enforce our contractual agreements, or otherwise as required by law.

INTERNATIONAL TRANSFERS

Vayoom is located in the United States. We process and store information on servers located in the United States. By using the Services, you consent to the transfer of your personal information to locations that may be outside of your country of residence, including to the United States. You acknowledge and agree that, as a condition of providing us with any information, you have legal authority to transfer it to the United States.

YOUR EUROPEAN PRIVACY RIGHTS

If you are an individual in the EU, we collect and process personal data about you only where we have legal basis for doing so under applicable EU laws, including under the EU General Data Protection Regulation (“GDPR”). The legal bases depend on the Service(s) you use and how you use them. This means we collect and use your personal data only where:

  • We need it to provide you the Service(s), including to operate the Service(s), provide customer support and personalized features and to protect the safety and security of the Service(s);
  • It satisfies a legitimate interest (which is not overridden by your data protection interests), such as for research and development, to market and promote the Service(s) and to protect our legal rights and interests;
  • You give us consent to do so for a specific purpose; or
  • We need to process your personal data to comply with a legal obligation.

If you have consented to our use of personal data about you for a specific purpose, you have the right to change your mind at any time, but this will not affect any processing that has already taken place. Where we are using your personal data because we or a third party (e.g. your employer) have a legitimate interest to do so, you have the right to object to that use though, in some cases, this may mean no longer using the Service(s).

We may use your email address to send you marketing communications or to inform you about our Service(s), such as letting you know about upcoming changes or improvements. We will ask for your consent in line with the applicable law when you first provide your personal data. We also allow you to opt out by following the unsubscribe directions in such communications.

If you wish to exercise any privacy right that is available to you, we will process your request in accordance with applicable data protection laws. We may need to retain certain information for record-keeping purposes and/or to complete transactions that you began prior to requesting any deletion. This set of processing rights excludes all situations in which Vayoom processes personal data of Vayoom’s customers and/or the customers’ clients on or through the Vayoom platform, where Vayoom is a data processor and not a data controller.

  • Right not to provide consent or to withdraw consent. Where we seek to rely on your consent in order to process certain parts of your personal data, you have the right not to provide your consent or to withdraw your consent at any time. In case of withdrawal, Vayoom will not process the personal data subject to this consent any longer unless legally required to do so. In case we are required to retain your personal data for legal reasons, such data will be restricted from further processing and only retained for the term required by law. Withdrawal of consent does not affect the lawfulness of the processing based on consent before its withdrawal. Furthermore, if your use of a good or service requires your prior consent, we will no longer be able to provide the relevant good or service to you after withdrawal of your consent.
  • Right of Information and Access. You can require Vayoom to confirm at any time that Vayoom is processing your personal data, or to have access to the personal data Vayoom may have about you. You may also request information about the purpose of the processing, the categories of personal data concerned, third parties that might have received the data from Vayoom, the source of the personal data, if you did not provide it directly to Vayoom, and how long it will be stored. Reasonable access to your personal data will be provided at no cost to you upon request. If access cannot be provided within a reasonable time frame, Vayoom will provide you with a date when the information will be provided. If for some reason access is denied, Vayoom will provide an explanation as to why access has been denied.
  • Right to Rectification. You have a right to correct the record of your personal data maintained by Vayoom if it is inaccurate.
  • Right of Erasure. In certain circumstances, you may have the right to the erasure of personal data that we hold about you, such as it is no longer necessary for the purposes for which it was originally collected.
  • Right to Data Portability. If Vayoom uses your personal data on the legal basis of either your consent or performance of a contract with you, you may also request from Vayoom a copy of the personal data you provided to us, clearly stating which personal data you require from Vayoom in which format and whether the personal data shall be provided to you or another recipient. We will carefully review your request and discuss with you how it can be best implemented.
  • Right to Restriction of Processing. You can request from Vayoom that Vayoom restricts your personal data from any further processing in any of the following events: (i) you state that the personal data Vayoom has about you is incorrect, (but only for as long as we are required to check the accuracy of the relevant personal data), (ii) there is no legal basis for us processing your personal data and you demand that we restrict your personal data from further processing, (iii) we no longer require your personal data but you claim that you require us to retain such data in order to claim or exercise legal rights or to defend against third party claims or (iv) in case you object to the processing of your personal data by us, where based on our legitimate interest, for as long as it is required to review as to whether we have a prevailing interest or legal obligation in processing your personal data.
  • Right to Object to Processing based on Legitimate Interest. Where we rely on our legitimate interest to process certain parts of your personal data, you have the right to object to such processing at any time. If you do so, we will cease using your personal data and remove it from our systems unless such personal data is permitted to be used by Vayoom for another purpose set out in this Privacy Policy or we determine and demonstrate a compelling legitimate interest to continue in processing your personal data.
  • Right to lodge a complaint. If you take the view Vayoom is not processing your personal data in accordance with the requirements set out in the Privacy Statement or applicable EU data protection laws if such laws apply to you, you can at any time lodge a complaint with the data protection authority of the EU country where you live or with the data protection authority of the country or state where the Vayoom controller that collected your personal data has its registered seat.

NOTIFICATION OF PRIVACY STATEMENT CHANGES

We may update this privacy statement to reflect changes to our information practices. We encourage you to periodically review this page for the latest information on our privacy practices.

OTHER TERMS AND CONDITIONS

Your access to and use of the Services is subject to the Terms of Service. This Privacy Policy is incorporated into, and forms an essential part, of the Terms of Service.
